These terms are a practical starting point, not a substitute for advice from an Australian commercial lawyer. Add your registered legal entity, ABN, address, tax status and governing state or territory before live launch.
Website use
You may use this website to review services, submit genuine enquiries, purchase a listed package and participate in the referral program. You must not interfere with the site, attempt unauthorised access, submit false identities, misuse referral codes or use automated traffic to exhaust limited offers.
Package scope
Package descriptions state the starting scope and price in Australian dollars. Before work begins, Black Oak may confirm deliverables, timing, content responsibilities and exclusions in writing. Work outside the agreed scope requires approval and may be quoted separately.
Payments
Stripe handles checkout. A project is reserved only when Stripe confirms successful payment. You are responsible for entering accurate contact and billing information. Taxes, third-party software, domains, hosting subscriptions and content production are included only when expressly stated in the agreed scope.
Client responsibilities
You must provide lawful content, timely feedback and any access reasonably needed to complete the project. You warrant that materials supplied by you may legally be used in the project. Delays in content, feedback or access may move the delivery date.
Intellectual property
Once the agreed balance is paid, you receive the rights to approved final project deliverables stated in the scope. Black Oak retains ownership of pre-existing tools, know-how, reusable systems, unused concepts and third-party materials. Third-party licences remain subject to their own terms.
Referral program
Referral participation also requires the terms shown on the referral page. Black Oak may reject or reverse self-referrals, fraud, duplicate attribution, refunds, disputes and chargebacks. Identity and payout verification through Stripe is mandatory. Limited promotions end when their published cap is reached.
Consumer rights and liability
Nothing in these terms excludes rights that cannot legally be excluded, including applicable Australian Consumer Law guarantees. To the extent permitted by law, liability is limited to the amount paid for the affected service and excludes indirect or consequential loss.
Contact
Questions, notices and service issues can be submitted through the secure contact page.
